DockWise Terms of Service

These Terms of Service ("Terms") govern your access to and use of DockWise (the "Service"), operated by DockWise ("we," "us," or "our"). By creating an account or using DockWise, you agree to these Terms.

1. Important Safety Disclaimer

DockWise provides educational guidance only. It is not a substitute for good seamanship, sound judgment, or the experience of a qualified boat operator.

Wind, weather, sea-state, and docking conditions can change rapidly and unpredictably. The guidance, ratings, and recommendations provided by DockWise are based on available data and general docking principles — they do not account for every variable present at your specific location and moment of arrival, including changing conditions, vessel-specific handling characteristics, or unforeseen hazards.

The captain and operator of any vessel remain fully and solely responsible for all docking, navigation, and operational decisions. DockWise, its owners, and operators are not liable for any damage, injury, loss, or harm resulting from reliance on information provided through the Service. Always exercise your own judgment, follow safe boating practices, and consult official marine forecasts and local authorities when conditions are uncertain.

2. Eligibility and Accounts

You must be able to form a legally binding contract to use DockWise. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or extract the underlying docking calculation logic, scoring formulas, or proprietary data models
  • Interfere with or disrupt the Service, servers, or networks connected to it
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
  • Use automated means (bots, scrapers) to access the Service without our express permission
  • Misrepresent your identity or impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Terms

DockWise offers a free tier with limited features and a paid subscription tier ("DockWise Pro") that unlocks additional features. Pricing and included features are described on our pricing page and may be updated from time to time; material changes to pricing will not apply retroactively to your then-current billing cycle.

By subscribing to DockWise Pro, you authorize us (through our payment processor, Stripe) to charge your provided payment method on a recurring basis according to the plan you select (monthly or annual), until you cancel.

5. Billing and Cancellation

  • Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date.
  • You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain Pro access until that period ends, and will not be charged again.
  • We reserve the right to change subscription pricing with reasonable advance notice.

6. Refund Policy

Payments are generally non-refundable, including partial-month or partial-year periods, except where required by law. If you believe you were charged in error, contact us at info@dockwiseai.com and we will review your request on a case-by-case basis.

7. Intellectual Property

DockWise, including its software, design, docking calculation logic, scoring algorithms, graphics, and content, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your personal or business boating purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, nor attempt to extract or reverse-engineer its underlying logic.

8. Third-Party Services

DockWise integrates with third-party services, including weather/marine data providers and Stripe for payment processing. We are not responsible for the accuracy, availability, or practices of these third-party services, though we select providers we believe to be reliable.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that docking guidance will be accurate or complete in all conditions.

10. Limitation of Liability

To the fullest extent permitted by law, DockWise and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of property, injury, or damages of any kind arising from your use of, or inability to use, the Service — including but not limited to damage to your vessel, injury to any person, or property damage occurring during docking, navigation, or any boating activity, regardless of whether such damages arise from reliance on information provided by DockWise.

In no event shall our total liability to you for any claim arising from these Terms or the Service exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DockWise and its owners and operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and cancel your subscription at any time.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above when changes are made. Continued use of DockWise after changes take effect constitutes acceptance of the revised Terms.
